Subscribers agree to pay Cariaccess Communications all charges on the rate schedule. 

Any payment received after or on days from the date of invoice will not be eligible for the discount amount.  Payment is due no later than thirty days from the date of invoice. 

Payments not received within the thirty days may result in termination of service and or charge interest at the rate of 1.5% per month. There may be a reconnection fee for nonpayment. 

Re-installments due to technical problems with the customer’s subscriber software or hardware are limited to two (2) per year. Thereafter, regular installation charges will apply.

Subscriber agrees to abide by the policies set forth by Cariaccess Communications Terms of Service.  Failure to abide by these policies may result in termination of all service.  Subscriber agrees that Cariaccess Communications makes no warranties, expressed or implied in connection with Cariaccess Communications Network or Internet.  Except in the case of breach of this agreement by Cariaccess Communications, subscribers agrees that Cariaccess will not be liable for any loss of service or other outages, damage to data, software, equipment or other loss, damage, expense or inconvenience.  Subscribers further agree that under no other circumstances shall Cariaccess Communications be liable for any incidental, consequential or indirect damages of any kind whatsoever. 

Subscriber acknowledges that Cariaccess Communications is not responsible for the nature of content of data available via the internet and so by using web sites and other services, hereby waves all claims against Cariaccess Communications whether in contract tort or strictly liable for damages, loss or injuries in connection with or arising out of the subscriber’s access to or use of the internet network.

POLICY

Access shall be intended to facilitate the exchange of information and otherwise be consistent with the broad objective of Cariaccess Communications.  Cariaccess Communications shall promote efficient use of the networks in order to minimize, avoid if possible, unnecessary network traffic and interference with the work of others of the service.  Rules that apply to the broad use of the Internet shall apply for all use of the service.  Failure to abide by these rules maybe grounds for disconnection.  Setup charges and the monthly, quarterly, bi-annual, annual or other charges are non-refundable and cover the expense of adding a user to the network.  Contracted rates are guaranteed, however prices and rates are subject to change without notice.

To suspend service and obtain credit for unused portions of your monthly service, please give us at least 7 days written notice of time to suspend account and the time to re-activate it.  Please note that your email will not be suspended and so will be available through the World Wide Web.

Your signature hereto or on service contracts signifies that you have read, understand and agree to the terms and conditions of this service agreement.
